Summary
Documents uploaded to the online Hearing Bundle can be verbally referenced by Counsel and then the EPE operator will be able to show them on the EPE screens.
We've set out how to call out references at the hearing below.
More information on: - How to display documents not uploaded to the online Hearing Bundle can be found here. - How native documents are displayed can be found here. - How to customise the EPE display can be found here.
Calling Out References
How documents are referenced during the hearing will differ depending on the structure and contents in each bundle. To ensure the EPE operator can efficiently find the correct document and the final transcript includes accurate references, Counsel will need to use the correct terminology, ensuring the reference is called out character for character.
Once a reference is called, the operator is required to input the reference into their system and search for the document, which is why each character is required to ensure an accurate result. Inaccurate or incorrectly formatted references requiring manual searching will lead to a delay in displaying documents on screen.
General Formatting
Documents - Counsel should refer to documents using the Bundle, Tab and Page reference assigned on the platform e.g. the document at F7/9/2 will be referred to as “please show the document at Bundle F7, Tab 9, Page 2”.
If there is an alternative referencing system that could be used e.g. Exhibit ID, please reach out to the Solution Operations team to discuss (ideally, in advance of the hearing).
Transcripts - Counsel should refer to Opus transcripts using the Day and Page reference assigned on the platform e.g. the transcript at Day 1CMC1, Page 5 will be referred to as "please show the transcript at Day 1CMC1, Page 5".
Confidentiality
EPE Access - If there are confidentiality restrictions and confidential documents need to be displayed, as our EPE operator will not be granted access to these as standard so we would need instructions to make confidential bundles available to the operator in advance of the hearing (unless already instructed).
Display Timings - The Operator will display documents referenced by Counsel regardless of their status, so it is Counsel's responsibility to ensure that when these are requested, the required room arrangements for confidential sections of the hearing are already in place.
